These devices promise breakthroughs in restoring mobility, enhancing cognition, and connecting humans to machines in ways never before imagined. But as they become more autonomous and personalized, they raise a difficult and unavoidable question:

But what if those recommendations are wrong?

Unlike car accidents or faulty medical devices, the lines of agency are shared—and therefore murky.
Why This Matters Now
These aren’t distant hypotheticals. In prototype environments today, users are testing BCIs that control prosthetics, influence mood, or assist with memory. As the technology scales, legal ambiguity will only grow. Without clear liability frameworks, victims may go uncompensated, manufacturers may evade accountability, and innovation may stumble under the weight of uncertainty.
The Way Forward
To address these liability grey zones, we need:
