But brain signals are different. They are not just another log of activity. They are sacred biometric expressions, carrying layers of information as intimate and unique as a genetic profile.

Why Brain Data Is Different

Every brain is distinct, shaped by genetics, experience, culture, and memory. And unlike surface-level data, brain signals can reveal aspects of identity that are both deeply personal and extremely difficult to protect:

  • Individual uniqueness. Like a fingerprint, neural patterns can serve as a personal identifier.

  • Emotional states. Unlike heart rate or blood pressure, brain signals reveal joy, fear, stress, or calm—sometimes before you are consciously aware of them.

What Must Be Done

If brain data is the digital equivalent of DNA, then society must treat it with extraordinary care. That means:

  1. Store brain data with the highest level of encryption. Just as DNA samples are locked behind rigorous security protocols, raw brain signals must be secured against hacking, leaks, or misuse.

  2. Restrict access to explicit, opt-in consent only. No hidden clauses in terms of service. No passive collection. Individuals must know when, why, and how their brain data is being used—and have the power to revoke consent at any time.

  3. Define legal protections for decoding. Governments must set clear rules: what can and cannot be inferred from brain data, and how such inferences can legally be applied. For example, neural signals should never be used in employment screening, insurance pricing, or criminal justice without explicit protections.

  4. Recognize brain data as a special class of privacy. Just as health records and genetic data receive heightened protections, brain data deserves its own legal category—“neurodata”—with rights that reflect its sensitivity and permanence.


A Different Kind of Privacy

Traditional privacy laws are built around the assumption that data can be deleted, reset, or anonymized. If a password leaks, you change it. If a credit card is stolen, you replace it.

But brain data doesn’t work that way.
You can’t reset your neural patterns. You can’t regenerate a new brainprint. You can’t delete memories once they’ve been exposed through data.

That’s why this isn’t just about stronger privacy—it’s about recognizing that neural privacy is human dignity.
